I had an argument with somebody regarding going to court for growing 20 plants. He said a friend of his recieved a lighter sentence because the plants had not formed buds ? I suggested that cultivating cannabis in the UK is illegal and whether the plants are a couple of weeks into a grow or about to be harvested the charge and the sentence is the same, buds have nothing to do with it.
Anybody got an opinion on this ?

Cheers for that, nothing about buds though? I have had a look online regarding the law and i can see nothing about the different
sentence for being caught with mature plants as opposed to baby plants. As far as i can work out a cannabis plant is illegal to grow, full stop, i can see nothing about a lesser sentence for pre budding plants ?
I posted on here because just maybe they are applying the law different in Yorkshire (where this person was nicked) and i doubt it.

england has the same law across the land.it is interpreted slightly ever so slightly differently county to county by police/judges.buds v no buds may not have been black and white...it could have been...
an only just started 3 weeks ago grow(beginer) v has had many many harvests(pro) scenario.
and thats what led to a lesser sentence ?
first offence for a 10 bag of weed in one part of the country = a caution slap on the wrist...another part of the country court apperance name in paper £200 fine and 1 year suspended for 2 years good behavior.
the 1st offence official caution is not automatic,its down to the discretion of the dpp/individual police force.

last i checked Radio 4 wasn't funny and this guy made me chuckle a few times :lol:
 
Sorry to chime in not being from UK but I agree with you law is the law.I have spent over 8 years in jail for multiple offenses. The way is works out it like bad strain never goes same way twice the judge has an obligation to look at the person his background and the charge and everything around it. They are all just ppl and may choose to be lenient in different ways so I'd say what went down is that crown attorney (may be called something different in UK it's the lawyer who works for city) was asking for required sentence pertaining to 20 plants. And the judge wasn't leaning that way. so what he does is states why he's not giving what they asked for or even what his lawyer asked for and one of the things may be that they didn't have a gram weight to go by. Still goes back to law is law because if that was the case he just got lucky with a judge willing to not throw book at him. It won't happen twice and it not being in flower would not be a get out of jail free card in any country I assume

Haha I grew a bunch of shitty pot and got stoned and wondered if the offense would be less because it wasn’t that good. Or the opposite, “But Judge, it was Mephisto...”
 
I'm not from the UK, I was facing I think it was 1 year' MIN. prison time for growing ONE plant, no matter what the size. You could have under an ounce of pot in the bag and get a mistermeanor, growing is completely different. Idaho has some bad law's. You can even refuse medical help to children, yes, lot's of preventable death's to kid's because of religious believe's. Wish I could spell. I moved about a year ago to a legal med. pot state, it sure is relaxing to grow legally-- even if it took 64 year's--- I forgot how stressful growing could be in a illegal place.
