Yeah laws just seem to be how they get us into court. how it plays out seems to be flip of a coin from some a**hole in a robe lol Canada the law is weird. Mostly in small town evidence or no evidence of he thinks it was you it was you. I've litterally done time as a youth for crime I didn't commit just because I had committed that crime before lol but the time it would take me to appeal it id be out and free and you never get that time back

Me three on time for no crime but then there was that time we bla bla bla .... Think some of it evens out for us nonviolent petty offenders, stupid stuff ....

Laws are changing but unfortunately not fast enough, especially for @doobydoobydo and his buddy .....

In my opinion, the Judge will take into consideration seriousness of crime and defendants respect for the “System” .....

Knowing your are already stewed throwing up another what might be taken as a reason / EXCUSE for what you did will not serve you well, Judge has heard it all, even your excuse ...... So do just opposite .....

I’ve sat in traffic court, more than once awaiting my turn before the Judge and on two separate occasions I’ve skated while others get fined and traffic school and all that BS .... What I said both times:

Guilty as Charged, Your Honor

and that was all I said, nothing more nothing less ... no hellos, nothing ....

Now if Judge asks a question of course you respond but look from his side, he wants you to be a Free Person, he has compassion but he also has to do his job and make sure you are safe to return to society ... so admit you violated the laws of the land, nothing about how you disagree- no BS just bow brother - hate to but they got ya in a spot ....

In my court cases, while different, still people .... and both times Judge was handing out fines and jail sentences left and right ..... Imwas kinda worried both times but relaxed, I was quilt - now we were here to decide just what was going to be done about it ....

One 43 mph in 30 and other was for 62 in a 50 ..... so not super serious but speeding but 12-13 mph over limits .....

Both Times ..... Court Supervision 6 Months, No Fine and Erased from Record

First Judge even said: “Now that’s the most honest one I’ve heard today” .... Of course it was, I plead guilty without an excuse .... not like yea I was speeding but I had an itch and went to bla bla bla, that excuse was actually funny, Judge laughed, one but he got fined / traffic court ....

Learned from a Foreman, I had excuse why late ..... He embraced me in front of the Crew and Said “The Best Escuse Is No Excuse” ...... Never forget that moment.

I got in touch with "release" with my question (release is a UK respected drug charity and has been around since the 60s) and got this reply. My understanding from this is that buds or no buds the charge and sentence are the same.

If someone is arrested for growing 40 marijuana plants, they will either be charged with the offence of Production of a Controlled Drug or the offence of Cultivation of Cannabis.


The sentencing for both Production of a Controlled Drug and Cultivation of Cannabis is the same. If the person is charged with either offence, and then convicted (pleaded guilty or found guilty at trial), the court decide the sentence based on the person’s role in the operation and the quantity of drugs found.


If the plants have not yet formed buds, it is much more likely that the charge will be Cultivation of Cannabis, as Production suggests that you have gone extra steps to prepare the plant for use (i.e. cutting and drying the flowers). A Cultivation charge can be brought at any stage in the plants’ growth cycle and the sentencing does not change whether or not the plant has flowered or not.


As I stated above, the sentence will be the same for a Production or a Cultivation charge. The main difference between a Production charge and a Cultivation charge is that the police are more likely to order a POCA (Proceeds of a Crime) hearing with a Production charge. This is a separate hearing that allow the courts to confiscate proceeds of a crime where the defendant is shown to have benefited from their criminal act (i.e. made financial profit from the sale of the cannabis).

Lol production charge is called trafficking here or possession with intent to traffic, which basically means they have other reasons other then just the drug just being there or it been dried and cured for use. It would have to be packaged in distribution size bags and so on. but they cannot prove unless you have sold it to someone so cell phone records, undercover, or snitches. I can remember got caught for 30 dimed up grams was random stop. They charged me with trafficing wanted 6 months. They couldn't prove I was selling them I said that's the way I buy them. I got 2 weeks time served. Couldn't believe the difference between being a drug dealer and drug user. in Canada proceeds of crimes is still the same. But charges way heavy for dealing, so crazy how laws differ. Just for drying and getting rdy for use. Allows them to take your stuff for proceeds seems crazy cool info tho thanks man

Legalization can’t come quick enough ..... So much BS for an alleged victimless crime .... I feel for the defendant .... Good luck.

1978 with a guy delivering 20lbs .... Got popped, bailed out and left the State - Dude got 5 years in the joint .... I moved halfway across the Country, I was only along for ride anyways and doing 5 years - F that - California is now a legal State thank goodness and I don’t think I have anything to worry about now, 41 years later living in another legal state now.

F that is right brother I guess we're on right path, still all messed but we're getting there half North America is legal somewhat

the drug charity "release" are brilliant and have been around since the late 60s. i was arrested in 1975, they didn't find any drugs but they found s collection of chillums that i had recently brought back from Afghanistan and India (the overland hippy trail). they were going to charge me with smuggling as they found traces in the chillums i got in touch with release and they managed to get the charges dropped. i also used release a couple of years later when they police got me with 5 tabs of acid, they provided a solicitor for free but i still got 6 months, times have changed now but release is still there helping people, google them

That must of sucked, hated wearing those bracelets, uncomfortable and made using restroom difficult
