Ill make it short as im wrecked. I got busted today, released a ill earlier, i got caught with a decent amount of hash. While i was in the cell i thought they were searchibg my house but they didn't ( i live in a strict place)
i got 5 huge plants thats been vegging for soon 3 months, should i just Cut them and take the loss?
What would you guys do, im scared shitless and i cant think Straigth


they also have my phone with pics on, but its got a screen lock.. Hope to god they cant take info and pics out still

if it were me id kill everything , better to be safe then sorry , possesion is bad enough , you dont want cultivation with intent on top of that

if they caught you out and about somwhere with hash , there really is no reason to suspect you of growing , im not sure they would have enough on you to get a warrant

im no law student or anything though , so maybe hold off until (hopefully) someone who has been through similar can chime in here

Thats a tricky one, there is an app u can get called keepsafe. I use it to store all my plant pics so if my phone does get found or confiscated hopfully they wont find that app and open it lol has a password on it too.

may i ask if you were busted at home or somewhere else? and did they say why they took your phone? i understand when u get arrested they take your property but im curious to why they took your phone and why you cant get it back.

edit: also is your screen lock an actual password or do you just got one of those: "slide bar to unlock" ones?

You can always grow again. Get rid of the plants and anything related (lights, nutrients etc)

Unless your phone is evidence in the crime you were arrested for it should have been returned to you upon release. And if the phone is locked a warrant is needed to go through it. Regardless GET A LAWYER and unless growing "legally" cut everything down or move em

In the US believe there is a case working up to Supreme Court (correct me if I am wrong--lazy today) concerning the ability of police to search cell phones during an arrest at booking. Police have been searching phones during arrests for a long time. If it is locked--I would think a warrant would be necessary after the fact (after arrest and release) based on probable cause. However, police are checking cell phones as part of the intake procedure--the equivalent of a purse or wallet. Good deal you had a password--if not they would have taken a look.

And do contact a lawyer. He or she will advise you not to discuss the facts of your case with anyone.

Stick with PM's here at AFN if you discuss the specifics with anyone. Commenting in generalities is fine.

First, it depends on what country and if in the U.S. what state... in the States it varies as laws are different at state and even local levels...

IF YOU ARE IN THE STATES...

I have experience with this from both sides and that's all I'll say for my security purposes. But, if you are in the states... first and foremost LAWYER UP. Don't say SHIT. Refuse to tell them anything and tell them any further questioning should be referred to your attorney. I'll repeat this and in bold... do not tell them anything! you have the RIGHT TO REMAIN SILENT. anything you tell them they will only use it to incriminate you and use it AGAINST you. So frankly, don't fuck yourself. Keep it zipped.

Secondly, in order to search your house, they need a warrant. In order to have a Warrant they need to present EVIDENCE to a judge/magistrate/etc... and there has to be enough prosecutable evidence to issue a Warrant. Unless you are a big time dealer, there won't be any huge rush to get the warrant issued. Meaning if they think you have 100's of plants or 100's of pounds you may have an hour to clear out your shit. In your case, a small amount of hash may not be enough evidence to issue a warrant (I don't know where you live so that's why I say MAY. I would assume in all 50 states it's NOT enough but again I don't know where you live. You can visit www.norml.org to see your state laws if you are in the states and to also seek legal counsel if don't know where to start as far as finding a good lawyer.)

Ditching your plants is up to you. Like I said again, it depends on where you live. Better to be safe than sorry. But most importantly LAWYER UP, Keep it ZIPPED, refer all questioning to your ATTORNEY, you DO NOT have to answer any of their questions no matter what they say to you. They lie - remember that. And research your local laws. Assuming you are in the States. I don't know anything about Canada, Europe, or any where else.
