Live Stoner Chat Its a sad day for Sweden and for Justin,,,and justice....

I had a Swedish friend with an outdoor grow..not that big either.
He got caught and got 6 Months and a 60,000 euro fine.

I'd advise you to Lawyer up..:tiphat:..you cannot give Good Arguments to people who are Close Minded..they will not even Listen.

Justinsane, arguments are for when there is some element of doubt regarding what happened and the point of law.

You were caught red handed growing a prohibited substance and were under the influence of said substance at the time of your arrest.

Get a lawyer that is sympathetic to your type of situation. Enrol in vet college, Uni or whatever your choice of educational establishment is, before your trial if possible. Abstain from canna use until your trial date so that you can demand a blood test to prove that you made a one off tragic mistake. Blame bad friends, the Internet, your relative youth (cos I suspect you're a young one) the movies, whatever it takes to prove that although guilty of growing and ingesting it was just a badly thought about experiment and now you know better.

The difference between policemen and judges is as glaring as the difference between sleep and death. Judges are generally very educated and astute individuals. They are usually conservative, risk averse, family oriented types.

Going to court to 'sock' it to the man; i.e. to tell the judge that the lawmakers, the law enforcers, and the majority of Swedes who still think canna is a harmful drug are all simple minded cretins is just not a game plan.

He who comes to equity, must come with clean hands and yours are not.....sorry.

The last thing you want is for any judge to see you as a recidivist...... Seriously, and I know what I am talking about.....

Enjoy your Sunday.

My opinion--shared by others.

Justinsane:

In Europe things get complicated legally. Not only your Swedish civil code but also the EU (a mix of civil/common law) body of law.

Common law is based on judge based decisions with the law as guidance.

Civil law is based on the rule as codified by law. Judges have little freedom of interpretation.

Your arguments would all be stacked up as either defenses or mitigating circumstances (if can get in prior to sentence) and defenses at law. Warrants and arrests are big deals in US, Canada and UK. All have to go thru a check off list in effect for "probable cause." Common law lawyers can argue anything with a legal basis from local law all the way up to US constitution. And they can not be charged with perjury--that is why everyone must let a lawyer speak--no matter what, unless, offense is just an inconvenience (traffic ticket).

I would find the best cannabis lawyer in Sweden and let him do his thing. With civil law--one can not fool around with the system. The system is harsh and inflexible--law is law.

Cheers

Im sure YOU got it right and google almost got it right :) Lovely to see some Swedish on here...makes my heart warm up :)

After some days of thinking I dont think i will even get a lawyer...I want to defend my self in this case....maybe real stupid but maybe not.
Justin

Admiring your fighting spirit, may I point out the slippery slope you are considering climbing. Perhaps at least a consultation with a real bulldog lawyer who has a history of winning rather than bargaining, will help you better understand the intricacies you face and the odds on your success. I don't know your capabilities in relation to law, but since most cases are won in discovery, where any flaws in the warrant itself or the procedures used appear, you will have to know how to navigate that maze right off the bat.. A good defense is important but a strong attack that destroys their case is better.

I just whant you all the best.. and i do have some insight..
they will use wet weight,, root mass and everything,, they don`t give a shit about dry weight,,,,
So what looks like 100g dry is about 1kg,,,

At this moment the politics in sweden is considering harder / longer sentence for drugs,
But that something to worry about next summer,
but they already carry it out,, in the domstolar,,
All the best

Hey buddy.

I am so glad that you dont know what you are talking about...lol

They DONT use either root mass or wet weight.
They took my plants and cut the steam just over my coco and dried that out.

All in all it was 312 grams dried and I all ready told them that the biggest part of them 312gram was just steams and leaves, dont know if they care or not but they wrote that in to the report any ways.

I am facing a trial sometime next year but my lawyer (yes I did get a lawyer) told me I have nothing to worry about. Just some fine and maybe a few hours of community service.

And I have now begun to study again....7 weeks in right now so my plans are going just like planed.

I will keep you updated when any news comes along.

Justin, I'm glad to hear that it will be more of an inconvenience than a life shattering event. Good move on the lawyer.

Glad to hear calm has returned to the woods.

Good news for you Justinsane. Now--you can breath freely once again. Not as bad as originally thought.

Cheers
