There's a lot wrong with entire law on so many levels
Dumb Rant Alert!
Despite legalization I knew this day would come. One of the reason I don't want any neighbours.
I've had my tent in my apartment and the (new) neighbours complained about the smell. Every time I water my plants I opened all windows so the smell can quickly escape outside, and due to incredible timing, they were either just leaving or coming back and the smell would hit them right in the face when exiting the building or the car.
Now I have my tent in my shed and just hope for the best..
The most idiotic thing is that before I had my tent, the other neighbours would simply ask if there's a way to reduce or eliminate the smell and that's where I said "yeah I know I'm sorry, all the stuff is on it's way" but the new ones proclaimed how bad it stinks so loud that I could hear them in my living room.
I would've been more understanding if they'd just told me they can't bear the smell at all.
Maybe I should file a complaint that they're coughing so loud I can hear them 2 floors down.
/End of rant/
So your neighbours complain. It's their issue. Yes, we should not annoy others with our hobby/craft/growing efforts. So far so good. That said, smell is NOT a crime, at best it's an Ordnungswidrigkeit. So your neighbour can call the cops, however, unless you've only the smell issue, that is not enough for raiding your house. Send them away, as if it's about smell, it's not part of the CanG. Instead, the ordnungsamt has to send someone, who checks for a violation of the Immissionsschutzgesetz (BImSchG). However, if you live in a street like I do (10 growers in our street alone), who will be able to tell or even messire that that smell is coming from you? Literally impossible and seriously, it's not your problem at all. It will get pretty expensive though for your neighbours if they have to go to court and pay for a "Gutachten", that most likely will not lead to anything other than wasting neighbours money and your time...since you know already about it, that 50 bucks for and akf is spend well.
In a house with multiple parties , growing stealthy still avoids trouble and honestly, even though we have it slightly in direction of legalization, we are far away from it , as long some people still are uneducated enough and place false statements of criminal evidence (f.ex. calling your 3 plants a huge plantage).
To me, before 1st April 2024 there was at least a law, that, if going against it, we knew the consequences. After 1st April we was given a not even halfly thoughtthrough text, free of interpretation and grey zones. Way too much ...which is causing more uncertainty than being a legal save and fun expirience. This is especially true, once it comes to the harvesting and drying process and the guesswork of "what the dryweight will truely be" to stay in the save 50g zone...
In other words, it's still better to keep up stealthy mode on all activity, even it's straight within the legal boundaries (which i asume it is).
If a neighbour ask out of curiosity, I found a lot are rather interested than against it. Had a few people who proudly grew a given seed or cutting, people that would have been so against it before 1st April (these also are the dangerous guys, like one of my neighbours, who told everyone passing by while waiting on mail-man, that he is now growing auto seeds he bought at a petrol station... another friend of mine grows her larfy plant straight towards the street... that are the people who will screw it up in the long run for all of us).
